Most companies know they need a PAIA Manual but they tend to miss the fact that they need to also submit a PAIA Report. Once a year, our wonderful Information Regulator asks businesses very nicely to submit a PAIA Report. And yes, the Information Regulator is paying close attention to this (Remember those emails we all got about the PAIA forms, I can’t tell you how many people panicked. )
What is the PAIA Report?
The PAIA Report is a formal submission that reflects your organisation’s PAIA activity, including whether you’ve received any requests for access to records, how those requests were handled, and whether internal procedures are in place. Even if you received zero PAIA requests, your reporting obligations may still apply.
Why do you need to submit a PAIA Report?
PAIA reporting is no longer a “nice-to-have”. It forms part of your broader compliance posture and it increasingly overlaps with POPIA compliance, governance expectations, and risk management.
If your business can’t show that it is compliant with PAIA reporting requirements, it raises serious questions about whether your organisation is operationally ready to handle:
- data subject access requests,
- record requests from employees or customers,
- regulator queries,
- or disputes where transparency becomes legally relevant.
The biggest risk we see
Many businesses assume that uploading a PAIA Manual to their website is enough. It isn’t. A PAIA Manual that is outdated, inconsistent with your actual internal processes, or unsupported by real reporting and governance structures is one of the fastest ways to expose your organisation during an audit, complaint, or compliance review.
What you should do now
If you haven’t already:
✅ ensure your Information Officer details are correct
✅ review internal records of any PAIA requests (even if none exist)
✅ submit accurately through the Information Regulator’s reporting platform
✅ keep proof of submission for your compliance fil
PAIA compliance is a business issue, not a legal formality
PAIA is enforceable law. And as South Africa moves into stricter regulatory oversight, businesses that treat PAIA as “admin paperwork” are the ones that end up exposed.
